How to Claim HRA Exemption with Valid Rent Receipts
Under the Income-tax Act, 2025 and Income-tax Rules, 2026 (effective 1 April 2026, replacing the 1961 Act), salaried employees who receive House Rent Allowance (HRA) can claim income tax deductions against residential rent paid when opting for the Old Tax Regime. To claim this exemption during annual employer tax declaration cycles, employees must provide formal rent receipts as documentary evidence, along with a disclosure of the landlord-tenant relationship. (Historical Note: For FY 2025-26 and earlier, HRA exemption was governed under Section 10(13A) of the 1961 Act).
Statutory Rules and Thresholds
- Annual Rent Exceeding ₹1,00,000: Under CBDT circular mandates, if total annual rent paid exceeds ₹1,00,000 (roughly ₹8,333/month), the employee must submit the landlord’s Permanent Account Number (PAN). If the landlord does not possess a PAN, a signed declaration stating they have no PAN, with full name and address, must be provided (confirm with your employer or a CA — Check the official source to confirm.).
- Revenue Stamp Guidelines: Verify with a CA whether a revenue stamp is required for cash payments in your state. For digital banking payments (UPI, NEFT, IMPS), bank records serve as electronic payment confirmation.
- Landlord-Tenant Relationship Disclosure: Disclosure of the landlord-tenant relationship is required. Rent paid to a spouse is often questioned; consult a CA.
- TDS on Rent: TDS applies to rent above the monthly threshold; check the current rate on incometax.gov.in (Check the official source to confirm.).
- Tax Regime: HRA exemption is available only under the Old Tax Regime; under the New Tax Regime, HRA deductions are not permitted.
How HRA Exemption is Calculated
Under current provisions (Rule 279 of the Income-tax Rules, 2026 — Check the official source to confirm.), exempt HRA is calculated as the lowest of three amounts:
- Actual HRA received from your employer during the financial year;
- 50% of basic salary + dearness allowance (DA) for Mumbai, Delhi, Kolkata, Chennai, Hyderabad, Bengaluru, Pune, and Ahmedabad, or 40% of basic salary + dearness allowance (DA) for any other location;
- Actual Rent Paid minus 10% of basic salary + dearness allowance (DA).
Historical Note: For FY 2025-26 and earlier under the 1961 Act and Rule 2A, the 50% limit applied only to four traditional metro cities (Mumbai, Delhi, Kolkata, Chennai), with 40% applied elsewhere.
